Minnetonka Moorings, Inc. v. City of Shorewood, 367 F.Supp.2d 1251 (D.Minn.,2005)

Yacht club brought action against city, alleging that zoning ordinance which permitted club to moor sailboats, but not powerboats, violated its rights under the equal protection and due process clauses of the United States Constitution and the Minnesota Constitution. City moved for summary judgment.

The District Court, Rosenbaum, Chief Judge, held that:
(1) zoning ordinance did not violate club's equal protection rights;
(2) criminal prosecution of club was not result of vindictive motive on part of prosecutor, as would violate club's due process rights; and
(3) city's denial of club's proposed amendment to its conditional use permit, and denial of club's request for amendment of zoning ordinance, did not violate club's due process rights.
